JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 03-05-2023 Due to some typographical error in cause title of order dated 18.7.2022 passed in Cri. Misc. No. 66793 of 2021, the name of petitioner no. 3 was typed as 'Saheb Singh' instead of 'Saheb Singh @ Ramesh Prasad'

Let the name of petitioner no. 3 be read as Saheb Singh @ Ramesh Prasad instead of Saheb Singh. The present petition has been filed for modification of the order dated 18.07.2022 passed in Cr. Misc. No.66793 of 2021 to the extent of extending the period of surrender. It is submitted by learned counsel for the petitioner that petitioner could not furnish the bail bonds on time since he was outside the State for his livelihood.

Since, vide order dated 18.07.2022, the petitioner was

Patna High Court CR. MISC. No.29635 of 2023(2) dt.03-05-2023 2/2 granted anticipatory bail whereas, the present modification petition seeking extension of time was filed on 29.04.2023, the petitioner is directed to deposit a sum of Rs 10,000/- before the District Legal Services Authority, Bettiah, West Champaran. Accordingly, the period of surrender is extended further for a period of four weeks from today. The bail bonds of the petitioner will be accepted by the learned Court below on showing receipt of deposit of Rs. 10,000/- before the concerned D.L.S.A..

The order dated 18.07.2022 passed in Cr. Misc. No. 66793 of 2021 stands modified to the extent as indicated above. Accordingly, the petition stands allowed.
