JUSTICE ANIL KUMAR SINHA ORAL ORDER 06-01-2022 Heard Mr. Chandra Mohan Jha, learned counsel for the petitioners and Mr. Madhura Nand Jha, Additional Public Prosecutor for the State via video conferencing. Petitioners seek regular bail in connection with Excise No. 84/2021 (PR No. 111/2021) registered for the offence punishable under Section 30(a) of Bihar Prohibition & Excise Act 2016.
The police intercepted a Safari Car and recovered altogether 166.140 litres of illicit liquor from the same and also arrested the petitioners from the car in question. Learned counsel for the petitioner submits that the petitioners are driver and cleaner of the said vehicle and they were not aware about the liquor kept inside the car by its

Learned counsel further submits that petitioners have got no criminal antecedent and are in custody since 14.03.2021. The charge-sheet, in the matter, has also been submitted. Having regards to the submissions made by the parties and taking into consideration the material on record and the fact that petitioners are in custody since 14.03.2021 having no criminal antecedent and they are not the owners of the car in question and the charge-sheet in the matter has been submitted, I am inclined to grant regular bail to the petitioners. Accordingly, let the petitioners, named above, be released on bail on furnishing bail bond of Rs.
25,000/- (Twenty-five Thousand) each with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Saran at Chapra in connection with Excise No. 84/2021 (PR No. 111/2021), subject to the condition that one of the bailors shall be a resident of the place falling within the territorial jurisdiction of the learned court below.
