JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-01-2016 Petitioner being brother of the husband of the victim is apprehending his arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

The accusation is of killing the sister of the informant after about 13 years of marriage. It is also alleged that accused persons also inflicted torture for demand of dowry.

It is submitted by learned counsel for the petitioner that after conclusion of the investigation the petitioner was not sent up for trial, but differing with the final form, cognizance has been taken. Though husband of the victim has been charge-sheeted.

Considering the fact that petitioner was not sent up for trial, let the petitioner, above named, in the event of

No.58043 of 2015 (2) dt.04-01-2016 2/2 his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Surajgarha P.S.
