Heard learned senior counsel for the petitioner and learned APP for the State.

The petitioner apprehends her arrest in connection with Piri Bazar P.S. Case No.134 of 2020 registered for offences under Sections 147, 148, 149 and 302 of the Indian Penal Code. Petitioner is a lady. She along with seven other persons have been named in the first information report and it is alleged that they all assaulted the deceased who sustained a number of injuries and died.

The petitioner is the purchaser of the land in dispute with regard to which Title Suit No. 57 of 2016 is pending because of that it is most probably that she has been falsely

The informant has stated that the deceased while being taken to the hospital has named all the accused persons who are said to have assaulted the deceased.

Considering the fact that the petitioner is not one of the participants in killing the deceased along with other accused persons, it seems that she has been falsely implicated. Moreover, there is no chance that she will abscond.

In these circumstances, this application for anticipatory bail is allowed.

Accordingly, let petitioner, above-named, in the event of her arrest or surrender within ten weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 1st, Lakhisarai in connection with Piri Bazar P.S. Case No.134 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
