The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 30 (a) of the Bihar Prohibition of Excise Act, 2018.

It is a case of recovery of illicit liquor from a Platina motorcycle.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that no incriminating article has been recovered from the conscious or constructive possession of the petitioner and the name of the petitioner has been disclosed by one Shiv Kumar and he has not been apprehended at the spot. Petitioner has clean antecedent.

Considering the aforesaid submissions, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Aurangabad in connection with Barun P.S. Case No. 127 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
