After some arguments, Mr. Krishna Bihari, learned Counsel for the petitioner, seeks permission to withdraw this application with liberty to the petitioner to approach this Court with appropriate application, in future, if so advised, including making a petition in the learned trial Court seeking splitting of the case of the accused-petitioner from those accused, who may have been absconding.
No objection has been raised by the respondents to the prayer for withdrawal made by the petitioner. In view of the above and in the interest of justice, this writ application is hereby disposed of as withdrawn with
Patna High Court Cr. WJC No.31 of 2016 (3) dt.30-01-2016 2/2 liberty granted to the petitioner to make a petition in the learned trial Court seeking splitting of the case of the petitioner from those accused, who may have been absconding. If such an application is made, the learned trial Court shall consider and dispose of the same in accordance with law by making speaking order within, preferably, a period of four weeks from date of receipt of the petition along with a copy of this order.
