In this case, the petitioner is apprehending his arrest in connection with Morkahi P.S. Case No. 60 of 2016 registered for offences under sections 302/34 of the Indian Penal Code. Allegation has been made that while the Informant along with his Bahnoi, Amarjeet Singh (deceased), Soni Devi and Children were returning from Bakhari to village Barua, Alauli and as soon as they reached near the Lachaka bridge, the accused persons stopped them and shot at Surendra Singh, the brother-inlaw of the Informant. The Informant also received injury and also caused death of the brother-in-law of the Informant. During investigation, the name of the petitioner has

Learned counsel for the petitioner submits that other co-accused persons have been granted anticipatory bail. Looking to the entire facts and circumstances of the case, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.

Accordingly, the prayer for anticipatory bail of the petitoier, namely, Mukesh Kumar @ Mukesh Singh is rejected. If the petitioner surrenders before the court below within a period of three weeks from today, the court below will decide the case on merit without being influenced by the present order.
