The petitioner has preferred this application for grant of regular bail in a case registered under section 396 of the Indian Penal Code and section 27 of the Arms Act. As per the prosecution case, the truck of the informant was overtaken by the accused persons who were in a Scorpio vehicle. It is stated that the accused in the Scorpio vehicle and a motorcycle looted the truck in question and one of the accused also fired upon the driver seriously injuring him, as a result of which he died.

It is submitted by learned counsel for the petitioner that the FIR was registered against 5 - 6 unknown accused persons. The name of the petitioner transpired in the

Patna High Court CR. MISC. No.37258 of 2021(3) dt.04-02-2022 2/2 confessional statement of a co-accused made before police. Even as per the said confessional statement it was Bhupendra Singh who fired on the driver. The petitioner is in custody since 10.12.2020 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the material that has transpired in course of investigation and the petitioner having remained in custody for more than 1 year, the petitioner is directed to be enlarged on bail in connection with Suryagarha P.S. Case no. 225 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai.
