Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Delha P.S. Case No. 77 of 2022 dated 15.03.2022 lodged under Section 392 of the I.P.C.

As per the prosecution case, the F.I.R. has been lodged against 4 unknown accused persons against whom allegation of robbery is there.

Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. rather his name has figured in this case by virtue of confessional statement of co-accused. He further submits that nothing incriminating has been

Counsel further submits that petitioner is in custody since 17.05.2022 and there are 4 criminal cases pending against him in which he is on bail. Counsel submits that the section under which he has been charged, is magisterial triable in nature.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Gaya in connection with Delha P.S. Case No. 77 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C. With this observation, the bail application stands allowed.
