JUSTICE MADHURESH PRASAD ORAL ORDER 20-04-2022 The present petition has been filed for restoration of the writ petition bearing C.W.J.C. No. 6058 of 2015, which stood dismissed for want of prosecution vide order dated 12-03-2019.

Learned counsel for the petitioner submits that due to non-marking of the cause list by his office and a communication gap, arising out of some illness, there has been default in appearance on two dates in the writ proceedings. He further

Patna High Court MJC No.1496 of 2019(4) dt.20-04-2022 2/2 submits that, in the circumstances, this Court should restore the writ petition for consideration on merits.

Learned counsel for the respondent-Bank is present. Having regard to explanation furnished in the petition and the submissions made in support thereof, this Court would find sufficient grounds for allowing the restoration petition. The same is allowed.

Let C.W.J.C. No. 6058 of 2015 be restored to its original file.
