JUSTICE PRABHAT KUMAR JHA ORAL ORDER 19-08-2017 Learned counsel for the petitioners prayed to withdraw the anticipatory bail petition of petitioner no. 2 Ramesh Sah of Cr. Misc. 29279/2017.

Patna High Court Cr.Misc. No.29279 of 2017 (3) dt.19-08-2017 2/3 Prayer is allowed. The anticipatory bail petition of Ramesh Sah petitioner no. 2 is dismissed as withdrawn. Heard both sides.

The petitioners of Cr. Misc.29279/2017 and Cr. 26791/2017 apprehend their arrest in Bhagwanpur P.S. Case No. 58/2015, registered for the offences punishable under Sections 304B, 201 and 34 of the Indian Penal Code.

The father of the deceased alleged that he married his daughter to Ramesh Sah son of Rambabu Sah six years ago. On 05.04.2015 the informant got information that his daughter fell down from the stairs and died. The informant alleged that all the accused persons killed his daughter and cremated her dead-body without giving information to him.

Learned counsel for the petitioner submits that the petitioners are father-in-law, brothers-in-law and other members of the family. The marriage was solemnized six years ago, but the informant or his daughter did not ever complain ill-treatment at the hands of the petitioners. The deceased died of injuries sustained on account of fall from the stairs. The petitioners have no manner of concern with the family affairs of the deceased and her husband.

Considering the facts aforesaid and the fact that

Patna High Court Cr.Misc. No.29279 of 2017 (3) dt.19-08-2017 3/3 petitioners are in-laws of the deceased, the petitioners abovenamed except Ramesh Sah, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate IIIrd, Vaishali at Hajipur in connection with Bhagwanpur P.S. Case No. 58/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
