Petitioner seeks bail in a case registered for the offences punishable under Sections 376,313,34 of the Indian Penal Code, Section 6 of the POCSO Act and Section 5 of the Medical Termination of Pregnancy Act, 1971.

The informant was in physical relation with coaccused-Ashraf Ali, as both were in love. When the informant was pregnant, Ashraf Ali took her to the medical center of the petitioner and her pregnancy was terminated. Ashraf Ali has already been allowed bail by a Coordinate Bench of this Court and the FIR does not disclose a case of termination of pregnancy without consent of the patient.

No.26508 of 2019(2) dt.23-04-2019 2/2 Hence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Dhaka Police Station Case No.226 of 2018, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
