This application for grant of regular bail arises out of Begusarai Mufassil P.S. Case No. 61 of 2020, registered for the offence punishable under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
The petitioner's for regular bail was earlier rejected by an order dated 08.12.2020 passed in Cr. Misc. No. 32299 of 2020, considering the gravity of the offence alleged against him and his criminal antecedent as has been noted in the said order dated 08.12.2020. The petitioner has following criminal antecedents : - "I. Begusarai Town P.S. Case No. 120/2015-under Section 399, 402, 307 I.P.C. and 25(1-B)a, 26/35 of Arms Act. II. Muffasil P.S. Case No. 193/2016-under Section 341, 323, 307, 504/34 I.P.C.
Patna High Court CR. MISC. No.37316 of 2021(3) dt.11-08-2021 2/2 III. Muffasil P.S. Case No. 234/2016-under Section 25(1-B)a/25, of Arms Act, 53 (B) Excise Act.
IV. Nagar P.S. Case No. 246/2017-under Section 341, 323, 386, 387, 120(B), 504, 307/34 of I.P.C.. V. Town P.S. Case No. 293/2018-under Section 307/34 of the I.P.C. and Section 27 of the Arms Act. VI. Begusarai Mufassil P.S. Case No. 79/2020-under Section 25(1-B)a, 26(2)/35 of Arms Act."
Learned counsel appearing on behalf of the petitioner has submitted that in similar circumstances co-accused Kanhaiya Kumar has been allowed regular bail by this Court by an order dated 17.03.2021 passed in Cr. Misc. No. 37654 of 2020.
I am, however, not inclined to accede to the prayer for grant of regular bail considering the petitioner's long antecedent as noticed hereinabove, which discloses his involvement in a number of serious offences.
This application is accordingly rejected.
It is, however, observed that learned trial Court should take all possible measures to ensure expeditious conclusion of the trial.
