Petitioner is an accused in connection with Sessions Trial No. 79 of 2019 arising out of Sasaram (M) P.S. Case No. 173 of 2018 for the offence registered under Sections 304(B) of the Indian Penal Code.
Earlier prayer for bail of the petitioner was rejected vide order dated 04.12.2019 passed in Cr. Misc. No. 47175 of 2019.
Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the instant case. It is further submitted that the petitioner is in custody since 06.10.2018.
Learned APP appearing on behalf of the State opposes
Patna High Court CR. MISC. No.28026 of 2020(2) dt.26-11-2020 2/2 the prayer for bail of the petitioner by contending that earlier prayer for bail of the petitioner was rejected on merit by a coordinate Bench of this Court. Now, there is no fresh ground to enlarge the petitioner on bail. Hence, he does not deserve to be enlarged on bail.
Having considered the entire facts and circumstances of the case, I am not inclined to grant bail to the petitioner. It is, accordingly, rejected.
