JUSTICE ARVIND SRIVASTAVA ORAL ORDER 03-11-2017 Heard learned counsels for the petitioners and the State. Petitioners apprehend arrest in connection with Araria P.S. Case No. 475 of 2017 registered for the offence punishable under sections 436, 427/34 of the Indian Penal Code. Learned counsel appearing for the petitioners submits that parties are on inimical terms as the sister of petitioner no. 3 is married to cousin of informant and the sister of petitioner no. 3 has filed a complaint case (Annexure-2) and other petitioners are witness in the said case. In retaliation, the present case has been lodged. As a matter of fact, on the alleged night cousin of informant came in inebriated condition and started abusing petitioners which was informed to the police and police

Patna High Court Cr.Misc. No.43656 of 2017(4) dt.03-11-2017 2/2 registered FIR for the same vide Annexure-3. Petitioners have no criminal antecedent.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioners, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Araria P.S. Case No. 475 of 2017 subject to the conditions laid down under section 438(2) Cr.P.C.
