In this case, the petitioner is seeking anticipatory bail in connection with Atri P.S. Case No. 394 of 2018, registered for the offence under Section 304 of the Indian Penal Code.

The husband of the informant sustained burn injury by electrocution and ultimately died. Allegation has been made that petitioner illegally took the electric power by an open electric wire, which was lying in the field and the deceased came in contract to the said wire, which result into his death. Considering the fact that the petitioner has criminal antecedent and also the nature of allegation, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer

Patna High Court CR. MISC. No.27413 of 2019(2) dt.26-04-2019 2/2 for bail is rejected. However, if the petitioner surrenders before the Court below within three weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order on the same day without being influenced by the order of this Court.
