2. The petitioner seeks bail in a case registered for the offence punishable under Sections 310 (2) and 317 (3) of the Bharatiya Nyaya Sanhita, 2023.

3. The allegation in the first information report is that five persons had hired an e-rickshaw, assaulted the driver of the e-rickshaw and looted away the vehicle.

4. It is submitted by learned counsel for the petitioner that F.I.R. has been lodged against unknown. The petitioner's name has transpired in this case subsequently during course of investigation on suspicion and confessional statement of the co-accused and his own confessional statement. It is further submitted that although the informant

No.27527 of 2025(3) dt.28-05-2025 2/2 claims to have identified the accused persons but no test identification parade has been conducted till date to establish the complicity of the petitioner. Further, the e-rickshaw had been recovered and the five batteries of the same was subsequently recovered from the co-accused, Satyam Kumar. There is no recovery from the petitioner. It is also pointed out that the charge-sheet has been submitted in this case. The petitioner has no criminal antecedent and has been languishing in custody since 19.01.2025.

5. Learned APP for the State opposed the bail petition.

6. Taking into consideration the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with N.H. Bangara P.S. Case No.11 of 2025.
