Mr.Pranav Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 10-07-2019 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Bhargama P.S. Case No. 281 of 2018, instituted for the offence under Section(s) 366(A) and 494 of Indian Penal Code.
It is alleged in the written report that on the date of occurrence younger daughter of the informant had gone with petitioner on Motorcycle to see Mela and did not return. It is further alleged that in the night petitioner telephoned his wife that he has taken younger sister of his wife to his village Chand Bela and he will perform marriage with her.
Case diary has been received.
The statement of victim girl recorded under Section 164 Cr. P.C. is available in paragraph 26 of the case diary wherein she has stated that she had gone with petitioner to see Mela. Thereafter she was taken by the petitioner to her sister's house from
Patna High Court CR. MISC. No.25222 of 2019(4) dt.10-07-2019 2/2 where she was taken to Chand Bela. Petitioner wanted to perform marriage with her. The elder sister of the victim girl has also given statement before the Police in paragraph-5 of the case diary wherein she has stated that her sister had gone to see Mela with this petitioner. He telephoned her and told that he will perform marriage with her sister.
In this manner, from the written report it appears that petitioner is own Jija of the victim girl. She had gone with him from Mela to his house.
Petitioner is in custody since 30.10.2018 having clean antecedent.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Bhargama P.S. Case No. 281 of 2018, subject to the condition that both the bailors will be close relatives of the petitioner.
