JUSTICE CHAKRADHARI SHARAN SINGH ORAL JUDGMENT Date: 04-04-2017 Heard learned counsel for the petitioner, learned counsel for the Central Board of Secondary Education and learned counsel for the State.

The petitioner passed 10th Examination in the year 2013, conducted by Central Board of Secondary Education (for brevity the "CBSE"). He has passed 12th Examination in the year 2015. His date of birth in the certificate issued by the CBSE has been mentioned as 10.11.1996. Petitioner's case is that his correct date of birth is 10.11.1998, and 10.11.1996 has wrongly been mentioned in the certificates, because of some

Patna High Court CWJC No.906 of 2016 dt.04-04-2017 fault at the stage of submission of form, as 10.11.1996. The petitioner, accordingly, seeks direction to the CBSE to make correct entry of his date of birth in the said two certificates.

On careful examination of the pleadings on record, I find that there is nothing specific on record to show that after 10th examination was declared in the year 2013, the petitioner raised any grievance against entry of his date of birth. There is no application or representation brought on record in this regard on behalf of the petitioner. The petitioner is said to have made a representation through his parents, as has been stated in paragraph 10 of the application. The said statement is vague, inasmuch as neither any date has been mentioned nor the representation has been brought on record.

In the background of the facts taken note of as above, and in view of the pleadings, no relief, as sought for on behalf of the petitioner, can be allowed.

Accordingly, this application stands dismissed as such.
