JUSTICE ARUN KUMAR ORAL ORDER 10-08-2017 Heard learned counsel for the petitioner and the learned APP appearing on behalf of the State. Petitioner apprehends his arrest in connection with Nayagaon P.S. Case No.51 of 2017, registered under Sections 448, 341, 323, 354, 379, 504, 506 and 34 of the Indian Penal Code. Allegation is that the petitioner along with another co-accused entered into the house of the informant in the evening at 6 P.M. and outraged her modesty and snatched away her Mangal Sutra.
Learned counsel for the petitioner submits that earlier a case was lodged by the daughter of the another co-accused against the husband of the present informant. In that case the accused persons made an attempt to kidnap her and also outrage
Patna High Court Cr.Misc. No.37290 of 2017 (2) dt.10-08-2017 2 / 2 her modesty as they were putting pressure for compromise in earlier case lodged by them as stated in the First Information Report lodged by the petitioner's side and this petitioner has got no criminal antecedent.
Having considered the said facts and circumstances and the fact that earlier case was lodged by petitioner's side for the same day of occurrence, so in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let petitioner, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-13th, Saran at Chapra, in connection with Nayagaon P.S. Case No.51 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C.
