JUSTICE SANJAY PRIYA ORAL ORDER 06-03-2018 Heard learned counsel for the petitioners and the State. The petitioner apprehends arrest in Ishakchak P.S. Case No. 77 of 2017 instituted for the offence under Sections-467, 468, 469, 419, 420, 406/34 of the Indian Penal Code.

It is alleged in the written report that petitioner along with other accused persons have opened non-banking company, namely, Vikramshila Mutual Benefit Company Ltd. The informant was working there in the capacity of agent. She deposited an amount of Rs. 2, 40,000/- of several customers including her own. When the informant and other depositors went to demand the money on maturity, they found that accused persons closed the company and refused to return the amount. Case Diary has been received. In para 6 and 7 several depositors have also supported the allegation. This is the case of defalcation of money of poor people

Patna High Court Cr.Misc. No.9471 of 2018 (3) dt.06-03-2018 2/2 by this petitioner by forming a non-banking company and he induced the people to invest the money in the said company to get high return. In the facts and circumstances stated above, considering the allegations attributed against the petitioner, I am not inclined to grant anticipatory bail to him and accordingly, his such prayer stands rejected in connection with Ishakchak P.S. Case No. 77 of 2017, pending in the Court of learned Chief Judicial Magistrate, Bhagalpur. Petitioner may surrender in the lower court and pray for regular bail and his prayer for regular bail shall be considered by the court below on its own merit in accordance with law without being prejudiced by the order of this Court.
