The petitioners are apprehending arrest in a case registered under Sections 341, 323, 354B, 379, 448, 504, 506 and 384/34 of the Indian Penal Code.

The prosecution case, in short, is that the petitioners and other accused persons named in the FIR abused and assaulted the informant. Petitioner no.1 caused injury on the head of informant with iron rod, whereas petitioner no.2 assaulted and abused informant's daughter-in-law. Accused persons looted cash and ornaments from the house of the informant.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is case

Patna High Court CR. MISC. No.26645 of 2019(3) dt.17-07-2019 2/2 and counter case bearing Jokihat Police Station Case No. 372 of 2018 lodged against the informant and others. Nothing has been recovered from the possession of the petitioners to connect them with the alleged offence.

Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below it within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria in connection with Jokihat Police Station Case No. 371 of 2018, GR No. 3805 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
