The petitioner is in custody in connection with Deepnagar P.S. Case No. 254 of 2018, registered for the offence punishable under Sections 272, 273, 291/34 of the Indian Penal Code and Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the in the instant case total 20 liters country made liquor was seized. Learned counsel for the petitioner submits that petitioner has surrendered on 29.3.2019 and there is no recovery from the conscious possession of the petitioner.

Considering the fact that nothing was recovered from the conscious possession of the petitioner, the Court is inclined
