The petitioner has filed the instant application for modification of the order dated 1.11.2021, whereby while granting bail to the petitioner in connection with Marhowrah P.S. Case No. 349 of 2019, the petitioner was directed that at the time of filing bail bond, petitioner as well as opposite party no. 2 will appear before the learned lower court and assert that they have amicably settled their dispute and are ready to lead the conjugal life together.

It is submitted by learned counsel for the petitioner, that informant is taking undue advantage of the condition, imposed by the Court and is demanding Rs. Ten Lakh for

Patna High Court CR. MISC. No.26336 of 2022(2) dt.29-06-2022 2/2 appearing before the learned court below.

Taking into consideration the submissions made on behalf of the petitioner, the Court is inclined to expunged the last paragraph of the order dated 1.11.2021 passed in Cr. Misc. No. 74161 of 2019.

The order dated 01.11.2021 passed in Cr. Misc. No. 74161 of 2019 is modified and the time granted to the petitioner in the said order to surrender in the learned Court below is extended by a further period of four weeks from today. The remaining part of the order shall remain unchanged.
