2 The petitioner apprehends arrest in Kharagpur PS Case No 374 of 2022 registered for the offence punishable under Sections 366A/34 of Indian Penal Code.

3 As per the prosecution case, on 18.07.2022 at around 2 am, the petitioner forcibly took away the minor daughter of the informant.

4 Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case.

5 Learned APP has vehemently opposed the prayer for anticipatory bail. It is submitted that the victim, in her

Patna High Court CR. MISC. No.28000 of 2023(3) dt.29-08-2023 2/2 statement recorded under Section 164 of Criminal Procedure Code, has supported the prosecution case and named this petitioner.

6 Considering the nature of accusation and Section 164, Cr P C statement of victim, I do not find it a fit case for grant of anticipatory bail. The same is rejected. (Prabhat Kumar Singh, J) M.E.H./- U T
