Petitioners apprehend their arrest in Jhajha P.S. Case No. 144 of 2015 under section 307 and other sections of the IPC. The informant alleged that while his father was returning to his house with his buffalo, Nago Yadav, the petitioner no. 1 and Surendra Yadav, the petitioner no. 2 along with Raju Yadav and others began to assault his father Palakdhari Yadav. When the informant and his brother went to save, the petitioners are alleged to have also assaulted them.
Learned counsel for the petitioners submits that there is
Patna High Court Cr.Misc. No.43619 of 2017 (2) dt.20-09-2017 2/2 omnibus allegation against the petitioners. Petitioners are cosharer of the informant. But it appears that Palakdhari Yadav got fracture injury on his head on account of assault made by the petitioners. The informant got one incised wound caused by a sharp cutting object and also one lacerated wound. The brother of the informant also got injuries.
Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, the same is rejected.
