Since the sole petitioner is dead, let the wife, namely, Indra Raj Devi, wife of the late Raj Ballv Singh, be substituted in his place.
It is evident from the counter affidavit, filed on behalf of respondents, sworn by the Executive Engineer, Road Division, Sheohar that pension paper etc. has already authorized and forwarded to Accountant General, way back on 17th of February, 2016; leave encashment has also been passed by the Treasury; group insurance has been paid; GPF final withdrawal has also been authorized and forwarded to the District Provident Officer, Sitamarhi on 19.01.2016.
Patna High Court CWJC No.16778 of 2014 dt.20-08-2016 2/2 In view of all these developments and now keeping in mind that the employee is dead and the wife is the legal heir, the respondents, including the office of Accountant General, if not authorized the GPO and PPO etc. in the name of the erstwhile employee, then development of the death would be taken into consideration and whatever is left is required to be now settled, preferably within a period of three months, if not already done.
