JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 31-01-2023 This writ application has been filed for directing the respondents to grant the scale of 2nd Time Bound Promotion from the date when the petitioner completed 25 years of his service and to pay him consequential benefits with interest. Learned counsel for the respondent submits that in context of letter No. 801 dated 14.11.2014 the Chief Engineer (M), Water Resources Department, Patna amended the pay scale of the petitioner in the light of order passed by coordinate Bench of this Court in CWJC No. 8322 of 2007 and allowed first and

Patna High Court CWJC No.16953 of 2014(3) dt.31-01-2023 2/2 second A.C.P. from 09.08.1999 to the petitioner vide Memo No. 3205 dated 21.11.2014 issued by the Chief Engineer (M) W.R.D. Bihar, Patna. Revised pay scale order has been issued by the Executive Engineer (M) F.M.D., Digha, Patna vide letter No. 832 dated 26.11.2014 in the light of order contained in Annexure-D to the counter affidavit. The request for revised pension to the petitioner has been sent to A.G. Bihar, Patna vide letter No. 833 dated 26.11.2014. Lastly, it is submitted that petitioner's claim for second time bound promotion had already been allowed by the order of Chief Engineer (M), Water Resources Department, Bihar, Patna vide memo No. 877 dated 08.03.2007 and as such, this writ application is fit to be dismissed.

Considering the statements made in the counter affidavit and the fact that grievance of the petitioner has already been redressed, this writ application has become infructuous and is, accordingly, dismissed.
