The petitioners are apprehending their arrest in a case registered under Sections 33, 41, 42, 52 and 64 of the Forest Act, 29 and 51 of the Wild Life Protection act and 25(1-b)a and 26 of the Arms Act.
Co-accused, Ram Jatan Singh, was arrested while he was using forest wood for fuel purpose and a gun was also recovered which was allegedly for the purpose of killing the animals. Submission is that the petitioners were not found at the spot and they have been falsely implicated. They have got no criminal antecedent, as per the statement made in paragraph 3 of the petition.
Let the petitioners, above named, in the event of their arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Forest Case No. 64 of 2016 to
Patna High Court Cr.Misc. No.50607 of 2016 (2) dt.23-11-2016 the satisfaction of the Chief Judicial Magistrate, Kaimur at Bhabhua, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code. (Birendra Kumar, J) SA/- U √ T √
