The petitioner apprehends his arrest in connection with Motihari Muffasil P.S. Case no. 635 of 2018, registered under Section 504, 506 and 387 of the Indian Penal Code. The accusation is that informant Lakhendra Das being the Block Education Officer, Motihari lodged the case against the petitioner for defalcating the money of Rs. 10,18,000/- at Motihari Muffasil due to that reason, the petitioner started abusing and also started giving threatening for dire consequences.

Learned counsel for the petitioner submits that, admittedly, the petitioner is a government teacher at Middle School, Thargatwa, whereas the informant is the Block

Patna High Court CR. MISC. No.26121 of 2019(2) dt.23-04-2019 2/2 Education Officer and due to some monetary dispute, the present case has been lodged by the informant. Further submission is that, now, the dispute has been settled between the parties and informant has filed the compromise petition in the Court of Chief Judicial Magistrate, Motihari on 12.10.2018, which would appear from Annexure-2. Further submission is that, except the case lodged by the informant, the petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari, East Champaran in connection with Muffasil P.S. Case No. 635 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
