The petitioner apprehends his arrest in Hajipur Town P.S. Case No. 835 of 2020, registered for the offences punishable under Sections 420, 406, 467, 468, 471 and 120(B) of the Indian Penal Code.

As per the prosecution case, this petitioner and coaccused Tetar Singh, Savitri Devi and their sons Manish and Chandan are alleged to have taken Rs. 26,77,000/- as Bayana from the informant for executing sale deed of a piece of land which belongs to Savitri Devi, but neither land was registered in the name of informant nor money was returned to him.

No.36871 of 2021(4) dt.23-06-2022 2/2 It is submitted that from bare perusal of FIR it appears that petitioner has not taken any money from the informant and the only allegation that this petitioner along with co-accused got cancelled the Jamabandi related to Savitri Devi, but as a matter of fact, Jamabandi has been cancelled by the Circle Officer vide Annexure-2. The dispute is of civil nature. Petitioner has got clean antecedent.

Considering the facts aforesaid and the fact that dispute is of civil nature, the petitioner above-named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur P.S. Case No. 835 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
