Learned counsel are appearing and making submissions from their residence. The Court master and Secretary are also part of this virtual Court proceedings with the aid of audio visual technology.

Heard learned counsel for the petitioner and learned APP for the State.

After some detailed arguments Mr. Ranjan, learned counsel, appearing for the petitioner submits that he would approach the Court below for grant of regular bail raising the fact that from the same place and at the same time in respect of

Patna High Court CR. MISC. No.23724 of 2020(2) dt.01-10-2020 2/2 the same recovery three different cases have been lodged. The petitioner is accused in one of the cases.

This Court would observe that if the petitioner approaches the Court below, needless to say, the Court below would exercising judicial discretion in accordance with law having regard to the submissions advanced by the petitioner. Withdrawal of the instant application shall not prejudice his claim for grant of regular bail based on the aforesaid submissions.

The application is dismissed as withdrawn.
