The petitioner is apprehending his arrest in connection with Sursand P.S. Case No. 101 of 2015 for the offences instituted under Sections 363, 366(A)/34 of the Indian Penal Code. As per prosecution case that the informant's daughter, namely, Mosamma Khatoon aged about 14 years had gone to call of nature in a bamboo orchard situated nearby the house in the meantime petitioner and co-accused Rabindra Das came and caught hold his daughter from back and closed her mouth from Gamchha and forcibly took her on the road where two motorcycles were standing.
It has been submitted on behalf of the petitioner that the
Patna High Court Cr.Misc. No.57969 of 2015 (2) dt.18-03-2016 petitioner has got no criminal antecedent. As per the allegation, an attempt was made for abducting the victim. Petitioner has falsely been implicated in the present case due to dirty village politics. The other co-accused have been granted anticipatory bail by this Court vide Cr.Misc.No.50000 of 2015.
On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Sursand P.S. Case No. 101 of 2015 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Pupri at Sitamarhi, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
