Petitioners apprehend their arrest in a case registered for the offence punishable under Section 302 and some other ancillary Sections of the Indian Penal Code and u/s 27 of Arms Act.

As per the prosecution case, all the FIR named accused persons, including these petitioners surrounded and abused and thereafter co-accused, Janardan Singh shot dead the husband of informant.

Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in the case due to enmity and land dispute. It is further submitted

Patna High Court CR. MISC. No.27269 of 2022(2) dt.26-09-2022 2/2 that police after investigation submitted final form against the petitioner but differing with the same the court below took cognizance against the petitioners. Petitioners have got clean antecedent.

Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case and specific accusation is against co-accused, Janardan Singh and police after investigation submitted final form coupled with the fact that petitioners have got clean antecedent, let the petitioners, above named, in the event of their arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st class, Lakhisarai in connection with Halsi PS case No. 151/ 2016, subject to conditions laid down u/s 438(2) of the Cr. P. C.
