Petitioner seeks bail in Khajekala P.S. Case No.236 of 2013 instituted for the offence under Section(s) 498-A, 379 Indian Penal Code.

Counsel for the petitioner submits that marriage took place about 45 years back in the year 1978. It is alleged that husband (petitioner) used to commit physical and mental torture with the informant. He has also performed another marriage with a 15 years old lady Afsa Perween.

Counsel for the petitioner further submits that informant is in the habit of filing false case against the petitioner. She has earlier filed a case under Section 498-A

Patna High Court CR. MISC. No.25199 of 2019(2) dt.23-04-2019 2/2 Indian Penal Code against the petitioner vide Khajekala P.S. Case No.170 of 2014 in which he has been granted anticipatory bail. Thereafter, the informant has filed this second case against the petitioner for causing harassment. Petitioner is an old man aged about 69 years.

Petitioner is in custody since 31.01.2019.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Patna City, in connection with Khajekala P.S. Case No.236 of 2013, subject to the condition that both the bailors shall be close relative of the petitioner. (Sanjay Priya, J) J. Alam/- U T
