Counsel for the petitioner submits that present writ application has been filed for directing the respondent concerned to issue no-objection certificate with regard to the land bearing Khata No.645, Khesra No.364, Area 1.17 Decimals and Khesra No.1419 and 1423 of said Khata area 0.38 Decimals situated in Mouza Bishanpur Anchal Korha, District- Katihar, which is a government land, so that Panchayat Sarkar, Agnabari Centre PACS Godown and Samudaik Bhawan could be constructed in Bishanpur Gram Panchayat for which the

Patna High Court CWJC No.19890 of 2014(3) dt.18-07-2023 2/2 Panchayat in its general body meeting has passed a resolution on 10.01.2014, for which funds have been made available but due to inaction of the authorities work has not been started.

3. Upon query that whether the petitioner is still continuing his authority in PACS, counsel for the petitioner submits that as per his knowledge petitioner has lost election.

4. In this view of the matter, this writ petition has become infructuous but liberty is hereby granted to the other members of the said newly elected Panchayat that they may sue for their grievances before the authority concerned.

5. With the aforesaid liberty, this writ petition is hereby disposed off.
