The petitioner is in custody in connection with Mahua P.S. Case No.319 of 2018 for the offences under Sections 414/ 34 of the Indian Penal Code and Section 25(1-b)G, 26II and 35 of the Arms Act.

Allegation against the petitioner is that from the possession of the petitioner one loaded pistol and cash of Rs.1600/- was recovered.

From the same occurrence, two cases were registered, one in Mahua P.S. Case No.318 of 2018, under Sections 395, 397 of IPC and another in Mahua P.S. Case No.319 of 2018 for the offences under Sections 414/ 34 of the Indian Penal Code Section 25(1-b)G, 26II and 35 of the Arms Act. In the case registered in Mahua P.S. Patna High Court CR. MISC. No.30758 of 2019(2) dt.08-05-2019 2/2 395, 397 of IPC petitioner has been granted bail. Learned counsel for the petitioner submits that petitioner is in custody since 07.10.2018.

Considering the fact that in the connected case, petitioner has been granted bail, the Court is inclined to grant bail to the petitioner. Let the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali, at Hajipur, in connection with Mahua P.S. Case No.319 of 2018 .
