JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-12-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Buxar Town P.S. Case No. 277 of 2016 registered for the offences punishable under Sections 409, 420, 166A, 120B/34 of the Indian Penal Code.

Petitioners were working as Headmasters and the allegation against them is that they along with others embezzled huge government money which had been allotted to the students under scholarship scheme.

Regard being had to the facts and circumstances of the case as well as submissions of the parties, I do not feel it proper to extend the privilege of anticipatory bail to petitioners

Patna High Court Cr.Misc. No.40356 of 2016 (3) dt.15-12-2016 2/2 and hence, their prayer for anticipatory bail in connection with Buxar Town P.S. Case No. 277 of 2016 pending in the court of Chief Judicial Magistrate, Buxar stands rejected. However, this order shall not cause any prejudice to the concerned court at the time of consideration of regular bail application of the petitioners.
