The petitioner seeks bail in Rajoun P.S. Case No. 470 of 2018, instituted for the offence under Section(s) 401, 414, 384, 212/34 of the Indian Penal Code and Sections 4/40 of Bihar Mines Mineral and Concession Rule, 1972. Counsel for the petitioner submits that petitioner is in custody since 4.1.2019.

It is alleged in the written report that Police recovered one Bullet Motorcycle without number plate from the house of co-accused Binod Kumar. He told before the Police that said Motorcycle belongs to the petitioner. There is no recovery of any incriminating article from possession of the

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Rajoun P.S. Case No. 470 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
