06-01-2022 Heard learned counsel for the parties through video conferencing.

The petitioner seeks bail in Chandi (Bena) P.S. Case No. 96 of 2020 registered for the offence under Sections 302, 323, 341, 504, 34 of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution case, on the order of coaccused Dharmendra Ram, co-accused Shankar Paswan fired from his pistol on son of the informant, as a result of which, son of the informant got injured and fell down. This petitioner alongwith other co-accused persons are alleged to have dragged the son of informant.

It is submitted on behalf of petitioner that specific allegation of causing fire-arm injury is against co-accused

Patna High Court CR. MISC. No.37124 of 2021(2) dt.06-01-2022 2/2 Shankar Paswan. It is further submitted that co-accused Dharmendra Ram has already been granted bail by this Court, vide order dated 24.11.2020 passed in Cr.Misc. No. 29610 of 2020 (Annexure - 3). Petitioner is in custody since 12.03.2021. Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Hilsa, Nalanda in connection with Chandi (Bena) P.S.
