====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ----------- 13-10-2017 Heard learned Senior Counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Baliya P.S. Case No.180 of 2017 registered under Sections 302 and 201/34 of the Indian Penal Code.

The accusation is that the informant Sharmila Devi performed the marriage of her daughter Rupam Kumari with Shambhu Yadav, son of Balo Yadav, in village-Pokhariya, P.S. Baliya, District-Begusarai before 8 years ago. Out of their wedlock, four female children were born out but out of them two died. Thereafter, the daughter of the informant was being tortured for demand of Rs.4,00,000/- from her father to get the same

Patna High Court Cr.Misc. No.48081 of 2017 (2) dt.13-10-2017 2/3 deposited in the bank due to giving birth of only female child. While the panchayati was arranged but despite that the daughter of the informant was being tortured. On 20.07.2017 at about 10.00 A.M., the informant made call to the father-in-law of her daughter to talk with her daughter but he made pretext. The informant raised suspicion and came to the matrimonial house of her daughter where she came to know that her daughter and one Natini have been killed by administering poison and the treatment of her one Natini is being going on at Ballia. Thereafter, the informant went there and found the health of her one Natini not well.

Learned Senior Counsel appearing on behalf of the petitioners submits that, in fact, the petitioners are Gotani, motherin-law and brother-in-law of the deceased, the daughter of the informant, respectively.

Patna High Court Cr.Misc. No.48081 of 2017 (2) dt.13-10-2017 3/3 of the informant, were survived.

Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with Baliya P.S. Case No.180 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
