====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 24-04-2019 Heard learned counsel for the petitioners and the State.

The petitioners seek bail in Raxaul P.S. Case No. 188 of 2018, instituted for the offence under Section (s) 302 and 201/34 of the Indian Penal Code.

It is alleged in the written report that son of the informant namely Vinay Kumar got traceless. The informant has raised suspicion against the petitioners and other coaccused that they kept concealed him. It is mentioned in paragraph-3 of the bail petition that Petitioners have no criminal antecedent. The names of petitioners have been disclosed by co-accused Firoz Khan @

Patna High Court CR. MISC. No.25374 of 2019(3) dt.24-04-2019 2/2 Ajay Kumar in his confessional statement before the Police during investigation.

Counsel for the petitioners submits that mere suspicion has been raised against the petitioners in the written report. He further submits that co-accused Baby Kumari @ Jyoti Kumari has already been granted bail by coordinate Bench of this Court vide order dated 2.4.2019 passed in Cr. Misc. 18186 of 2019.

Petitioners are in custody since 22.10.2018 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Raxaul at Motihari, in connection with Raxaul P.S. Case No. 188 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioners.
