JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-12-2016 Heard learned counsel for the petitioners as well as learned APP for the State.

The petitioners pray for anticipatory bail in connection with Dharahara P.S. Case No. 58 of 2016 instituted for the offences punishable under Sections 420 and 406/34 of the Indian Penal Code.

It has been submitted on behalf of the petitioners that as a matter of fact, the petitioners are themselves the victim of the occurrence and they have no concerned with the company rather Sweety Kumari was an agent of the company. It has further been submitted that the petitioners have falsely been implicated in this case although they have also deposited the amount in the company.

Patna High Court Cr.Misc. No.45447 of 2016 (2) dt.15-12-2016 2/2 Heard the learned APP also.

Having heard both sides, in view of the fact stated above, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Munger in connection with Dharhara P.S. Case No. 58 of 2016, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to the cancelled.
