The petitioner is apprehending arrest in a case registered for the offences punishable under Section 395 of the Indian Penal Code.

On commission of robbery in the house of the informant, the FIR was registered against unknown. The name of the petitioner sprang up during investigation on confession of co-accused.

It is submitted by learned counsel for the petitioner that except the confessional statement of co-accused there is nothing against the petitioner. Moreover, no recovery has been made from the petitioner and a statement has been made in paragraph 3 of the petition that the petitioner has no criminal

The aforesaid facts constitute ground for consideration of prayer for regular bail. Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Bahadurganj P.S. Case No.43/2014, pending before the learned CJM, Kishanganj.

With the above observation, this application is, accordingly, disposed off.
