The sole petitioner, apprehending his arrest in Pirpainty P.S. Case No.124/2016 registered for the offence under Sections 306,511 of the Indian Penal Code, has prayed for grant of bail, in the event of his arrest or surrender. By way of referring to F.I.R., learned counsel for the petitioner submits that the victim, who was major, had committed suicide inside the house of the informant, who was mother of the deceased and the mother has become informant of the present case with an allegation that her daughter had committed suicide on the basis of torture given by the petitioner.
Patna High Court Cr.Misc. No.38294 of 2016 (2) dt.17-09-2016 2/2 He submits that in the F.I.R. itself, the informant has disclosed that her daughter was in love with the petitioner. He submits that on the basis of F.I.R. itself, the petitioner may not be held responsible for the offences, which has been alleged. On the contrary, learned counsel for the petitioner has argued that on the basis of fact disclosed in the F.I.R., which suggests that the deceased had committed suicide in her own house by sprinkling kerosene oil, finger can be raised against parents of deceased. In view of fact disclosed in the F.I.R. the Court is satisfied that it is a fit case for grant of anticipatory bail.
Accordingly, let the petitioner, namely, Deepak Kumar @ Deepak Poddar, in the event of his arrest or surrender within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XI, Bhagalpur in connection with Pirpainty P.S. Case No.124/2016, subject to conditions as laid down in Section 438(2) of the Code of Criminal Procedure.
