JUSTICE SANJAY PRIYA ORAL ORDER 10-10-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in Sakri P.S. Case No. 56 of 2016 instituted for the offence under Sections-304(B), 201, 34 of the Indian Penal Code.
It is alleged in the written report that on 10-07-2016, the informant received information about the death of his sister in her Sasural. The informant and his family members requested the accused persons not to dispose off the dead body till their arrival but the accused persons disposed off the dead body of the deceased before arrival of the informant in haste. The daughter of the deceased aged about 7 years told that the deceased has been killed by strangulation by this petitioner and his other family members. The petitioner is husband of the deceased.
Counsel for the State has submitted that in paragraphs-22 and 53 of the case diary also, witnesses have levelled allegation against
Patna High Court Cr.Misc. No.44580 of 2017 (3) dt.10-10-2017 2/2 this petitioner of causing death of sister of the informant and of cremating the dead body hurriedly.
Therefore, this court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail is rejected.
The petitioner is directed to surrender in the court below and seek regular bail, which will be considered on its own merit without being prejudiced by this order.
