The petitioner apprehends his arrest in connection with Nawkothi P.S. Case no. 57 of 2016, registered under Sections 406 and 504 of the Indian Penal Code.
The accusation is that informant/complainant supplied coal at the brick kiln of the petitioner on credit since 2012 till 2014, but petitioner has not paid the price of the coal worth of Rs. 13,83,625/- to the informant.
Learned counsel for the petitioner submits that, in fact, the informant talked to sale a land in Bakhari market regarding which he also paid Rs. 10,00,000/-, but later on informant refused to execute the sale deed and petitioner made request to return the said money, if he is not willing to execute the sale deed, but informant lodged this
Patna High Court Cr.Misc. No.45885 of 2016 (2) dt.13-12-2016 2/2 false case only to give pressure upon the petitioner. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Begusarai in connection with Nawkothi P.S. Case No. 57 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
