JUSTICE ANIL KUMAR SINHA ORAL ORDER 28-09-2020 Heard Mr. Bachan Jee Ojha, learned counsel for the petitioner and Mr. Chandra Bhushan Prasad, learned Additional Public Prosecutor appearing for the State through video conferencing.

Petitioner seeks regular bail in connection with Brahmpur P.S. Case No. 64 of 2020 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

The allegation against the petitioner as per the First Information Report is that the house of one Sanjit Kumar was raided by the Police and a total quantity of 276.48 liters of illicit English liquor was recovered from the same. It has further been alleged that the said Sanjit Kumar disclosed the name of the petitioner.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case with oblique motive on the basis of statement made by the arrested co-

Patna High Court CR. MISC. No.25656 of 2020(2) dt.28-09-2020 2/2 accused, from whose house the illicit liquor in question has been recovered. Learned counsel further submits that petitioner is in custody since 26.03.2020.

Having regard to the submissions made by the parties, taking into consideration the materials available on record and the fact that petitioner has got criminal antecedent, I am inclined to grant regular bail to the petitioner after framing of charge. Accordingly, let the petitioner, above named, be released on regular bail after framing of charge on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II-cum-Spl. Judge (Excise), Buxar / court concerned in connection with Brahmpur P.S. Case No. 64 of 2020. It is made clear that at the time of furnishing bail bond all the parties shall follow the guidelines regarding lockdown and social distancing.
