The petitioner apprehends his arrest in Doriganj P.S.Case No.250 of 2017 registered under Sections147, 148, 149, 188, 341, 383, 353, 332, 333, 307, 120 (B) of the Indian Penal Code.

The informant alleged that while some people were making storage and transportation of the sand from the river bed despite restriction put by the High Court and the State Government, raid was conducted. The police wielded lathi. The police arrested 31 persons. Thereafter one spy is said to have disclosed name of this petitioner. Name of the petitioner figured at Serial No.80.

Patna High Court Cr.Misc. No.17731 of 2018 (2) dt.05-04-2018 2/2 Learned counsel for the petitioner submits that petitioner was not apprehended on the spot and nothing has been recovered from the possession of the petitioner. It is further submitted that three cases Doriganj P.S.Case No.250 of 2017 and the nature of allegation made against the petitioner and the fact that the petitioner figured from the mouth of spy but no specific allegation is attributed to the petitioner, the petitioner, above named, in the event of his arrest of surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-7th, Chapra, in Doriganj P.S.Case No.250 of 2017 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
