====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 25-04-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Maniyari P.S. Case No. 104 of 2017 registered under Sections 341, 323, 307 and 504/34 of the Indian Penal Code and Section 27 of the Arms Act. Later on, Section 302 of the Indian Penal Code has been added, pending in the court of Judicial Magistrate Ist Class, Muzaffarpur.

The accusation is that on the occasion of marriage procession, due to some dispute, on the order of this petitioner, nephew of Radhe Singh fired causing injury to informant, Gena Ram, who was member of band party, died later on. Having considered the facts and circumstances of

Patna High Court CR. MISC. No.27097 of 2019(2) dt.25-04-2019 2/2 the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
